Due to the COVID-19, the China National Intellectual Property Administration (CNIPA) will defer its conduct of lots for *identical trademark registrations that are filed on the same day designating the same goods/services.

* In accordance to the China Trademark Law and Trademark Implementing Rules, if there are two or more identical trademark applications with similar classes designating similar goods/services, the CNIPA will grant registration to the application that have prior use, whilst in the case where both applications use their mark on the same day or have not begun to use, the CNIPA will request the applicants to negotiate. If the applicants refuse to do so, the CNIPA will decide the registration by lots.
